ORDINANCE

CITY OF MONROE                                                                                   

 

The following Ordinance was introduced by  Muhammad                , who moved for its adoption, and was seconded by  Woods                    :

AN ORDINANCE AUTHORIZING THE GRANT OF A UTILITY SERVITUDE AND RIGHT-OF-WAY ACROSS CERTAIN PROPERTY OWNED BY THE CITY OF MONROE IN FAVOR OF ENTERGY LOUISIANA, LLC, AND FURTHER PROVIDING WITH RESPECT THERETO.

WHEREAS, the City of Monroe owns certain property located at 4701 Central Avenue, Monroe, Louisiana (the “Property”);

WHEREAS, the Property is currently leased to Brookshire Grocery Company for use as a warehouse facility;

WHEREAS, Entergy Louisiana, LLC requested that the City grant a utility servitude and right-of-way across a portion of the Property, as described more fully in Exhibit “A,” for the purpose of constructing, installing, operating, and maintaining overhead and underground electrical facilities, including service to a transformer located at the warehouse;

WHEREAS, the utility servitude is necessary to facilitate electrical service improvements to the Property and to ensure the continued operation and use of the warehouse; and

WHEREAS, granting the requested utility servitude and right-of-way is in the best interest of the City as it will support the continued productive use and functionality of municipally owned property.

            NOW THEREFORE, BE IT ORDAINED that the utility servitude and right-of-way across a portion of the Property in favor of Entergy Louisiana, LLC is hereby approved and granted and that Mayor Ellis, or his designee, is hereby authorized to execute any and all documents necessary to effectuate the grant of the utility servitude and right-of-way.

This Ordinance was introduced on April 14, 2026.

            Notice published on  April 17th and May 1st, 2026.

This Ordinance having been submitted in writing, introduced and published, was then submitted to a vote as a whole, the vote thereon being as follows:

AYES:            Woods, McFarland & Muhammad

NAYS:            None.

ABSENT:      Harvey & Ezernack

And the Ordinance was declared ADOPTED on May 12, 2026.
