NOTICE

NOTICE is hereby given that a public hearing will be held on the following Ordinance, Tuesday, May 13, 2025 at 6:00 p.m., in the Council Chamber at Monroe City Hall:

STATE OF LOUISIANA
CITY OF MONROE

The following Ordinance was introduced:

AN ORDINANCE DECLARING CERTAIN PROPERTY IN THE MONROE AIR INDUSTRIAL PARK NO LONGER NECESSARY FOR PUBLIC USE AND AUTHORIZING SAID PROPERTY TO BE SOLD AT PRIVATE SALE TO HILAND DAIRY FOODS, LLC AND FURTHER PROVIDING WITH RESPECT THERETO.

WHEREAS, the City of Monroe is the owner of a 2.44 acre tract of land located in the Monroe Air Industrial Park that was released by the Federal Aviation Administration from federal obligations in 1998 (Deed of Release; CB 2593, P 884);

WHEREAS, Hiland Dairy Farms, LLC has requested that the City of Monroe sell to it the 2.44-acre tract and submitted a preliminary proposal for development of the property, which includes constructing distribution facilities for Hiland Dairy’s regional operations;

WHEREAS, the Monroe Air Industrial Park, after considering the preliminary proposal, unanimously recommended (8-0) the sale of the property to Hiland Dairy Farms;

WHEREAS, the purchase price for the property is $65,000.00, which is equal to the appraised value of the property;

WHEREAS, the Cash Sale Deed conveying the property to Hiland Dairy Farms, LLC is attached hereto and made part hereof; and

WHEREAS, the property is no longer necessary for public use, and the Monroe City Council deems the sale of the property subject to the terms and conditions of the Cash Sale Deed to be in the best interest of the City of Monroe.

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that:

Section 1. The City Council does hereby declare the following 2.44-acre tract of land located in Monroe Air Industrial Park in the City of Monroe, Louisiana as no longer necessary for public use:

Commencing at the intersection of the Southerly right-of-way line of Transport Avenue and the Easterly right-of-way line of Cargo Lane; Thence N 5 degrees 14’ 00” E, along the northerly projection of said easterly right-of-way line of Cargo Lane, a distance of 80.00 feet to the northerly right-of-way line of Transport Avenue, a distance of 70.38 feet to the west line of a tract of property sold to Sol Rosenburg described in Conveyance Book 1698, Reg. No. 1197545 and the Point of Beginning; Thence continue N 84 degrees 46’ 06” W, along said northerly right-of-way line of Transport Avenue, a distance of 300.00 feet; Thence N 5 degrees 13’ 54” E, a distance of 354.80 feet; Thence S 84 degrees 46’ 06” E, a distance of 300.00 feet to the west line of a tract of property sold to Sol Rosenburg described in Conveyance Book 1698, Reg. No. 1197545; Thence S 5 degrees 13’ 54” E, along said west line of Sol Rosenburg, a distance of 354.80 feet to the Point of Beginning. Containing 2.44 acres, more or less. This tract is subject to a 12 foot wide sewer servitude, (6’ each side of existing sewer line). This tract is also subject to a 30 foot right-of-way along the westerly line which be extinguished if Savannah Inc. purchases a 1.00 acre optional tract lying north of the tract described herein, as shown on the sketch titled “Proposed Land Sale – Savannah Forestry Equipment” by the City of Monroe Engineering Department, dated Sept. 23, 1997.

        Section 2. On behalf of the City of Monroe, Louisiana, Mayor Friday Ellis is hereby authorized and empowered to sell the property, for cash, at private sale, to Hiland Dairy Farms, LLC of North Louisiana under the terms, conditions and for the consideration set forth in the Cash Sale Deed which is attached hereto and made part hereof.

Section 3. Mayor Friday Ellis is hereby authorized and empowered to execute the said Cash Sale Deed for and on behalf of the City of Monroe, Louisiana.

Section 4. The City of Monroe shall comply with any applicable federal and state laws or regulations governing the dispensation of such property and any applicable covenants and restrictions contained in the September 8, 1949, Deed between the City of Monroe and the United State of America conveying said property to the City of Monroe.

Section 5. Under the provisions of Louisiana Revised Statute 33:4712, prior to the final adoption hereof, notice of this Ordinance was published in the official journal three (3) times within fifteen (15) days, one week apart.
