The following Ordinance was introduced by Woods , who moved for its adoption and was seconded by McFarland :
AN ORDINANCE AMENDING SECTION 9-24 (PERMIT FEES) OF THE CITY OF MONROE CODE TO PROVIDE RELATIVE TO PERMITS FOR THE PLACEMENT AND TRANSPORTATION OF MOBILE HOMES, MANUFACTURED HOMES, BUILDINGS, AND OTHER STRUCTURES; TO REQUIRE APPLICABLE STATE LICENSURE; TO REQUIRE A TRANSPORT MOVING PERMIT FOR THE MOVEMENT OF CERTAIN STRUCTURES OVER PUBLIC STREETS, ALLEYS, AND RIGHTS-OF-WAY; AND FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, Section 9-24 of the City of Monroe Code establishes permit requirements and fees for buildings, structures, mobile homes, and other construction-related activities within the City of Monroe;
WHEREAS, Section 9-24(i) presently requires a permit before a mobile home or trailer house may be placed or located for habitation or occupancy within the City;
WHEREAS, the City Council desires to update Section 9-24(i) to reflect the City’s current administrative structure and the Permits and Inspections Division’s responsibility for issuing such permits;
WHEREAS, the City Council further desires to ensure that persons and entities engaged in moving houses, buildings, manufactured homes, mobile homes, and other structures within the City possess all licenses required by applicable state law; and
WHEREAS, the movement of houses, buildings, manufactured homes, mobile homes, and other structures over public streets, alleys, and rights-of-way may affect public safety, traffic, and City infrastructure, and the City Council therefore desires to require a Transport Moving Permit before such movement occurs within the City.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Monroe, in legal and regular session convened, that Section 9-24(i) of the Code of Ordinances of Monroe, Louisiana, is hereby amended to read as follows:
Sec. 9-24. Permit Fees
(i) No mobile home and/or trailer house shall be placed or located for habitation or occupancy within the city unless a permit shall have first been obtained from the Permits and Inspections Division approving such placement or location. Upon application for such permit, a fee in the amount of one hundred dollars ($100.00) shall be paid by the applicant.
BE IT FURTHER ORDAINED that Section 9-24 of the Code of Ordinances of Monroe, Louisiana, is hereby amended by adding subsections (k) and (l), to read as follows:
(k) No permit required by subsection (i) or (l) of this section shall be issued to any person, firm, or corporation engaged in the business of moving or transporting houses, buildings, manufactured homes, mobile homes, or other structures unless such person, firm, or corporation possesses all licenses required by applicable state law for the work to be performed, including, as applicable, licensure by the Louisiana Manufactured Housing Commission or the Louisiana State Licensing Board for Contractors. The applicant shall provide satisfactory evidence of such licensure upon request by the Permits and Inspections Division.
(l) No person, firm, or corporation shall move, haul, or transport any house, building, manufactured home, mobile home, or other structure over, along, or across any
public street, alley, or right-of-way within the municipal limits of the City of Monroe without first obtaining a Transport Moving Permit from the Permits and Inspections Division.
BE IT FURTHER ORDAINED that all other paragraphs, subsections, subparagraphs, clauses, phrases, and words of Section 9-24 not specifically amended by this Ordinance shall remain unchanged and in full force and effect.
BE IT FURTHER ORDAINED that if any provision of this Ordinance is found invalid, the remaining provisions shall remain in full force and effect.
