EMERGENCY ORDINANCE

NO. 12,119

The following Ordinance was introduced by Woods who moved for its adoption and was seconded by Dawson:

AN ORDINANCE EXTENDING A PRIOR EMERGENCY DECLARATION, DECLARING AS AN EMERGENCY THE CONDITION OF THE TEXAS TO STANDIFER SEWER TRUNK LINE BETWEEN LEE AVENUE/NICHOLS STREET AND DICK TAYLOR STREET/MOUTON STREET NECESSITATING DEMOLITION, BYPASS AND REPAIR OR REPLACEMENT AND OTHER REPAIRS, AND AUTHORIZING ADDITIONAL WORK AND FURTHER PROVIDING WITH RESPECT THERETO.

WHEREAS, the City of Monroe operates the Texas to Standifer sewer trunk line located in the City of Monroe.

WHEREAS, because of a cave-in in the trunk line in the vicinity of the intersection of Standifer and Gordon Streets, Council adopted Emergency Ordinance No. 12,055, declaring the condition of the Texas to Standifer Sewer Trunk Line at the intersection of Standifer and Gordon an emergency necessitating demolition, bypass and repair or replacement and other repairs further providing with respect thereto.

WHEREAS, during the work under Emergency Ordinance No. 12,055, project representatives determined that the degradation of the structural capacity of the existing concrete pipe extended beyond the areas previously identified but within the general vicinity of the existing emergency.

WHEREAS, additional work is required to be performed to ensure the integrity of the work on the existing emergency, and to prevent imminent danger to the health, safety, and welfare of the public due to a potential complete failure of the pipe in the surrounding area.

WHEREAS, based upon an engineering evaluation the recommended repair is to replace and or bypass the impacted area with new pipe from Lee Avenue/Nichols intersection to Mouton Street/Dick Taylor Street intersection.

WHEREAS, the City of Monroe believes that condition of the surrounding pipe and its relationship to the current work under Emergency Ordinance No. 12,055 is an extension and part of the existing emergency, and thus warrants a change order authorizing further work under Emergency Ordinance No. 12,055.

WHEREAS, in the alternative, the condition of the pipe in the surrounding area itself is an imminent danger to the health, safety, and welfare of the public that would constitute an emergency on its own.

WHEREAS, in light of these circumstances, the City immediately undertook to solicit emergency repairs in the newly identified areas with the preparation of specifications and communications with on-site contractors to locate and mobilize resources for the necessary repairs and replacement.

NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that: Emergency Ordinance No. 12,055 is hereby extended to include those portions of the Texas Standifer Sewer Trunk Line between Lee Avenue/Nichols intersection to Mouton Street/Dick Taylor Street intersection, including the surrounding vicinity, and further repair and replacement including the demolition, bypass, surveying, engineering and acquisition of materials, easements and rights of way and is hereby authorized; and the condition of the Texas to Standifer Sewer Trunk between Lee Avenue/Nichols intersection to Mouton Street/Dick Taylor Street intersection including the surrounding vicinity, is declared an emergency posing a danger to the public necessitating repair and replacement including the demolition, bypass, surveying, engineering and acquisition of materials, easements and rights of way and is hereby further declared a continuing emergency.

BE IT FURTHER ORDAINED that such emergency repairs necessary to repair the condition are authorized and Mayor Friday Ellis or his designated representative of the City of Monroe is authorized to enter into such contracts or change orders as may be necessary to complete the project and abate the emergency conditions.

This Ordinance having been submitted in writing and was then submitted to a vote as a whole, the vote thereon being as follows:

AYES: Woods, Marshall & Dawson

NAYS: None.

ABSENT: Harvey, Ezernack

And the Ordinance was declared ADOPTED on  26th   day of  April, 2022.
