ORDINANCE

 

 

STATE OF LOUISIANA

CITY OF MONROE                                                                                    NO. 12,142                

 

The following Ordinance was introduced by Mr.  Marshall                           who moved for its adoption and was seconded by Mrs.  Ezernack                      :

 

AN ORDINANCE AUTHORIZING STACEY ROWELL, DIRECTOR OF ADMINISTRATION, TO ENTER INTO AND EXECUTE A LEASE BY AND BETWEEN THE CITY OF MONROE AND BERRY PLASTICS CORPORATION, AND FURTHER PROVIDING WITH RESPECT THERETO.                                                                                   

 

            WHEREAS, Berry Plastics Corporation, by itself or through its predecessors in interest, has been conducting operations on property it leases and/or owns within the Monroe Air Industrial Park;

 

            WHEREAS, in 2010, in addition to land that Berry Plastics Corporation already leased, the City of Monroe leased an additional tract of land to Berry Plastics Corporation (known as “Parcel C”) within the Monroe Air Industrial Park to continue and expand its operations;

 

            WHEREAS, Berry Plastics Corporation’s lease for Parcel C has expired and it wishes to enter into a new lease agreement with the City of Monroe;

 

WHEREAS, the land identified as Parcel C is not needed for public use and has been previously leased to Berry Plastics Corporation for its operation and it is in the best interest of the City to continue its lease with Berry Plastics Corporation; and

 

            WHEREAS, a copy of the Lease Agreement with the property description of Parcel “C”, is attached hereto and made a part hereof.          

 

BE IT ORDAINED, by the City Council of the City of Monroe, in legal session convened, that Stacey Rowell, Director of Administration, be and she is hereby authorized and empowered for and on behalf of the City of Monroe, Louisiana, to enter into and execute a Lease Agreement between the City of Monroe and Berry Plastics Corporation, a copy of said Lease Agreement setting forth the terms and conditions thereof is attached hereto and make a part hereof.

NOTICE PUBLISHED on October 31st and the  7th & 14th  day of  November, 2022.

 

This Ordinance having been submitted in writing, introduced and published, was then submitted to a vote as a whole, the vote thereon being as follows:

 

AYES:            Ezernack, Woods, Marshall & Dawson

NAYS:            None.

ABSENT:      Harvey

And the Ordinance was declared ADOPTED on the  22nd    day of  November , 2022.
