STATE OF LOUISIANA

CITY OF MONROE                                                                      NO. 12,026                    

 

The following Ordinance was introduced by Mrs.  Dawson                         who moved for its adoption and was seconded by Mrs.  Ezernack                                 :

 

AN ORDINANCE ACCEPTING THE DONATION OF SEWER IMPROVEMENTS BUILT ON A PUBLIC RIGHT OF WAY FROM CBS INTEREST, LLC AND FURTHER PROVIDING WITH RESPECT THERETO                    _______________                             

 

WHEREAS, in conjunction with existing sewer lines, utilities and facilities that are within the public right-of-way of Forsythe Avenue, made by CBS INTEREST, LLC; and

 

WHEREAS, it has been determined that the sewer improvements were actually made on existing public right of ways; and

 

WHEREAS, the City of Monroe engineering department has determined that the improvements were built according to an approved plan and made pursuant to applicable City of Monroe codes; and

 

WHEREAS, CBS INTEREST, LLC desires to donate said improvements to the City of Monroe and the City of Monroe hereby accepts such donation.

 

WHEREAS, CBS INTEREST, LLC is donating and dedicating said sewer main to the City of Monroe for the public use.

 

NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that the Transfer/Donation of sewer improvements made by CBS INTEREST, LLC to the City of Monroe is hereby accepted as per the attached agreement.

 

            BE IT FURTHER ORDAINED that Friday Ellis, Mayor, be and he is hereby duly authorized to accept this Donation on behalf of the City of Monroe.

 

This Ordinance was introduced on the  27th         day of  October          , 2020.

Notice published on the  30th          day of  October                    , 2020.        

 

This Ordinance having been submitted in writing, introduced and published, was then submitted to a vote as a whole, the vote thereon being as follows:

AYES:            Ezernack, Woods, Marshall & Dawson

 

NAYS:            None.

 

ABSENT:       Harvey

 

      And the Ordinance was declared ADOPTED on the  10th      day of  November     , 2020.
