ORDINANCE

STATE OF LOUISIANA                                                                       NO.  11,973                      

CITY OF MONROE

 

The following Ordinance was introduced by Mrs.  Ezernack                        who moved for its adoption and was seconded by Mr.  Clark                     :

AN ORDINANCE AUTHORIZING THE CITY OF MONROE TO ENTER INTO A SERVITUDE, RIGHT OF WAY AND EASEMENT AGREEMENT BETWEEN THE CITY OF MONROE AND ATMOS ENERGY CORPORATION, AND FURTHER PROVIDING WITH RESPECT THERETO

 

WHEREAS,the City of Monroe desires to enter into the attached Servitude, Right-of Way and Easement Agreement with Atmos Energy Corporation  (“Atmos”) related to the properties outlined in the attached agreement and more specifically listed below for the purposes of Atmos erecting, installing, constructing, owning, operating and maintaining certain above and below ground facilities comprising natural gas regulating, metering, odorization, compression, or other station, together with all related meters, risers, piping, valves and other facilities and equipment appurtenant thereto as deemed necessary for Atmos;

 

WHEREAS, the property described hereinafter in this Ordinance is needed and necessary for said project; and

 

NOW, THEREFORE, BE IT ORDAINEDby the City Council of the City of Monroe, Louisiana in legal session convened, that James E. Mayo, Mayor, be and he is hereby authorized and empowered for and on behalf of the City of Monroe to enter into the Servitude, Right-of-Way and Easement Agreement attached hereto and made a part hereof to the following described properties, to-wit:

 

LOTS TWO (2) AND THREE (3) AND THE WEST TWENTY (20) FEET OF LOT FOUR (4), IN BLOCK EIGHT (8), OF FARMER’S STREET EXTENSION TO THE CITY OF MONROE, LOUISIANA, AS PER PLAT IN CONVEYANCE BOOK “T”, PAGE 162 OF THE RECORDS OF THE PARISH OF OUACHITA, STATE OF LOUISIANA

This ORDINANCE was introduced on the  26th        day of  November           , 2019.

 

            NOTICE PUBLISHED on the  29th        day of  November            , 2019.

 

     This Ordinance having been submitted in writing, introduced and published, was then submitted to a vote as a whole, the vote thereon being as follows:

 

            AYES:             Ezernack, Woods & Clark

 

            NAYS:            None.

 

            ABSENT:       Wilson & Echols

 

            And the Ordinance was declared ADOPTED on the  10th    day of  December         , 2019.
