The following Ordinance was offered by  Dawson who moved for its adoption and was seconded by  Harvey:

AN ORDINANCE AMENDING ORDINANCE NO. 12,083 TO CORRECT THE ANNEXED BOUNDARIES OF I-20 CORRIDOR PROPERTIES & NORTH AMERICAN LAND DEVELOPMENT CORPORATION, PROVIDING FOR THE RECORDATION OF THE ENTIRE BOUNDARY AS AMENDED, ESTABLISHING THE EFFECTIVE DATE THEREOF, AND PROVIDING FURTHER WITH RESPECT THERETO:

WHEREAS, in September 2021, I-20 Corridor Properties, LLC (“I-20 Corridor”) and North American Land Development Corporation (“NALDC”) filed a Petition for Annexation (ANX 102-21) and Map Amendment Application to annex certain property into the City of Monroe city limits;

WHEREAS, the Petition for Annexation identified several parcels of property, comprising roughly ±54-acres, to be annexed, but due to a clerical error, portions of the legal descriptions pertaining to the referenced parcels were omitted or incorrectly transcribed from the legal descriptions;

WHEREAS, due to the clerical error, the incorrect legal descriptions were included in Ordinance 12,083, which annexed the property into the city limits;

 WHEREAS, I-20 Corridor, NALDC, and the City of Monroe intended to fully annex the identified parcels into the city limits;

WHEREAS, the previous formalities for annexation were followed, Council has determined that the annexation is in best interest of the City of Monroe, and Council approved the annexation of these properties in Ordinance 12,083; and

WHEREAS, amending Ordinance 12,083 to correct the legal descriptions of the property will serve the interests of the City, I-20 Corridor, and NALDC, and permit the proper annexation of the property,

NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Monroe, Louisiana, in legal session convened, that the legal descriptions in Ordinance No. 12,083 are hereby amended and restated as follows to include said property within the boundaries of the City of Monroe:

Tract 1(Parcel 117514)

A certain tract parcel of land situated in Section 34, Township 18 North, Range 4 East, City of Monroe, Ouachita Parish, Louisiana containing 4.247 acres more or less and being more particularly described as follows:

Commencing at the Southeast corner of said Section 34; thence, N89°59’42”W for a distance of 2698.08 feet; thence, N00°22’02”W along the west line of Fontana Road for a distance of 445.22 feet to a point; thence N84°52’38”W for a distance of 673.69 feet to the Southeast corner of a certain 31.6 acre tract of land acquired by the City of Monroe recorded in Conveyance Book 768, page 712 of the records of Ouachita Parish, Louisiana, said point being 200 feet (called 100 feet) west of the west line of a parcel sold to Frank C. Cappo as per deed in Conveyance Book 445, page 673, said corner being the POINT OF BEGINNING; thence continue N84°52’38”W along the north line of a certain 41.161 acre tract acquired by the Hakim Properties in Conveyance Book 1907, Page 236, for a distance of 511.36 feet to the intersection with the southeasterly line of the Existing Ultimate Clear Zone for the Monroe Airport (Runway 4-22); thence, N36°31’11”E for a distance of 847.86 feet to the intersection with the east line of said 31.6 acre tract; thence S00°22’30”E along said east line for a distance of 727.06 feet to the POINT OF BEGINNING  and being subject to all rights-of-way, easements and servitudes of record or of use.

A certain tract parcel of land situated in Section 34, Township 18 North, Range 4 East, City of Monroe, Ouachita Parish, Louisiana containing 7.975 acres more or less and being more particularly described as follows:

Commencing at the Southeast corner of said Section 34; thence, N89°59’42W” for a distance of 2698.08 feet; thence N00°22’02”W along the west line of Fontana Road for a distance of 445.22 feet to a point; thence, N84°52’38”W for a distance of 673.69 feet to the Southeast corner of a certain 31.6 acre tract of land acquired by the City of Monroe recorded in Conveyance Book 768, page 712 of the records of Ouachita Parish, Louisiana, said point being 200 feet (called 100 feet) west of the west line of a parcel sold to Frank C. BE IT FURTHER ORDAINED, that within ten (10) days after the adoption hereof the description of the enlarged boundary of the City of Monroe, after inclusion of the previously described property, shall be recorded by the Clerk of the City of Monroe in the Conveyance Records for Ouachita Parish, Louisiana, and such description as recorded shall become the official boundary of the Municipality as of the effective date of this Ordinance, all in accordance with the provision of LA-R.S. 33:171 et seq.

BE IT FURTHER ORDAINED, that this Ordinance shall be effective thirty (30) days after adoption and publication hereof on the manner prescribed by law.
